Terms of Service

1. Acceptance of Terms
By accessing or using CarGence ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. CarGence is operated by CarGence Inc. ("Company," "we," or "us").
2. Description of Service
CarGence provides automotive market intelligence tools including vehicle pricing analysis, AI-powered recommendations, VIN decoding, pre-purchase inspection checklists, financing calculators, and related features. The Service is intended to assist consumers in making informed vehicle purchasing decisions.
CarGence does not sell vehicles, arrange financing, provide appraisals, or act as a licensed automotive dealer in any jurisdiction. All pricing data and AI recommendations are informational only and should not be construed as guarantees of market value.
3. Accounts and Subscriptions
You must create an account to access paid features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Subscription fees are billed in advance on a monthly or annual basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial periods except as required by law.
A 7-day refund is available on your first charge if you are not satisfied. Contact support@cargence.com within 7 days of the initial charge.
4. Acceptable Use
You agree not to:
- Scrape, crawl, or systematically download data from the Service
- Attempt to reverse-engineer or extract our pricing algorithms or AI models
- Use the Service to compete with CarGence by building a similar product
- Share your account credentials with other users
- Transmit malicious code or attempt unauthorized access to our systems
- Misrepresent vehicle condition or pricing information to third parties
5. Data Accuracy Disclaimer
Vehicle pricing data is derived from third-party market sources and updated periodically. CarGence makes no warranty that pricing data is current, complete, or applicable to any specific vehicle. Market conditions change rapidly; always verify with current listings and an independent appraisal before completing a purchase.
AI-generated recommendations are based on patterns in historical data and should be used as one input among several in your buying decision — not as the sole basis for any financial commitment.
6. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by CarGence Inc. or its licensors and are protected by applicable intellectual property laws. You may not reproduce or redistribute any portion of the Service without prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, CarGence Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
8. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Delaware.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or prominent notice in the Service at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
